1. Parties and acceptance
This Agreement is between BackHome and you as an individual who prepares food at home for sale through the Platform ("Producer"). By submitting an application you accept this Agreement, the Terms of Use and the Privacy Policy. Your listing is activated only after BackHome approves your application and the plan payment is in place; approval is at BackHome's discretion and does not certify your food or premises.
2. You sell; BackHome lists
You sell directly to customers. BackHome is an intermediary and technology provider, not a food business operator, co-producer, employer or agent. Pre-orders are contracts between you and the customer.
3. Legal status and permits
You confirm that selling home-prepared food is lawful where you live, that you hold every registration, permit, inspection approval, food-handler certificate and insurance that your municipality, province/state and country require, that you will keep them current, and that you will provide copies on request. If the law in your area prohibits the sale of a food type from a home kitchen, you will not list it.
4. Food safety undertaking
You undertake to: prepare food only in the kitchen you declared; keep it clean and free of pests and household contamination; store ingredients at safe temperatures; wash hands and use clean utensils; keep animals out of the preparation area while preparing; not prepare food while ill with a communicable disease; label products with ingredients, allergens and a preparation date; use safe packaging; and comply with any inspection or guidance from the authorities.
5. Allergens and descriptions
You are solely responsible for accurate product descriptions, ingredient lists, allergen and dietary information and photos. Customers rely on them; BackHome does not verify them.
6. Address privacy and pickup
Your exact address is hidden from customers until an order is accepted; only an approximate location is shown. You control whether you offer pickup or delivery and are responsible for safe handover.
7. Fees and BackHome Credit
Your participation is paid through the plan you selected (subscription or credit-pool commitment) as described in the corresponding Plan Addendum shown in your panel. Customers may pay with BackHome Credit purchased for you; you must honour valid credit payments at face value.
8. Orders, timeouts and cancellations
You must accept or reject pre-orders within the time shown in the panel; unanswered orders are cancelled automatically and refunded. Once you accept, you must deliver what was ordered; cancellation after acceptance follows the rules shown to the customer.
9. Liability, insurance and indemnity
You are liable for food-safety, product-liability, illness, allergen and consumer claims arising from your food and you indemnify BackHome against them. You are strongly advised to hold product-liability insurance. BackHome's liability to you is limited as set out in the Terms of Use.
10. Suspension and termination
BackHome may suspend or remove your listing immediately upon a substantiated complaint, an inspection order, a recall, a food-borne-illness report or any breach of this Agreement, and may share relevant information with the authorities where required. You may stop selling at any time; accepted orders must still be fulfilled or refunded.
11. Evidence of acceptance
Your acceptance of this Agreement is recorded with version, time, IP address, device and a cryptographic fingerprint of the text in a tamper-evident ledger and may be used as evidence.
12. Canada — home-based food rules
Home-based food businesses are regulated provincially and municipally (for example Ontario's Food Premises Regulation exemptions for low-risk foods, British Columbia's home-based food guidelines, and Québec's MAPAQ permits). You confirm that the foods you list are permitted from a home kitchen in your province and municipality, that you hold any required permit, and that you will stop listing any food the authority does not allow.
